In light of the recent passage of Issue 2, which legalizes recreational adult-use cannabis in the state, Bryan City Council is preparing to prohibit dispensaries and cultivators from operating within city limits.

On Monday, council will have first readings on two ordinances: one to prohibit cannabis operators, cultivators and dispensaries within city limits and one to prohibit them within the C-3 downtown zoning district.

The ability for municipalities to prohibit new dispensaries is explicitly defined within the provisions of Issue 2.

It also states that existing marijuana facilities cannot be ousted or limited, and municipalities cannot limit the home use or home growth of cannabis.

By passing a prohibition, Bryan would not receive tax revenue from the “host community cannabis fund” that is to be created for municipalities with dispensaries.
